1.- COMPANY ORGANISING THE PROMOTION

The company El Palacio del Embrujo S.L., with registered address at Calle Matemáticos Rey Pastor y Castro, 4, 41092, Seville, and identified with number B41705971 is organising a prize draw (hereinafter, ‘the Promotion’), to be carried out over the Internet, exclusively for users in accordance with the provisions of the participation requirements section.

The purpose of this prize draw is to reward the loyalty of our followers.

2.-START DATE AND END DATE

The Promotion will take place in Spain and will begin on 15 October 2024 at 12:00 hours (GMT +1:00 Madrid) and will end on 22 November 2024 at 23:59 hours (GMT +1:00 Madrid).

The Company reserves the right not to proceed with the promotional action if by the reflected starting date of the promotional action there has not been more than 100 participants. Likewise, the Company may extend the end of the promotional action for one more week, the new end date being 29 October 2024 at 23:59 hours (CET +1), in the event that fewer than 100 participants are registered.

3.- PARTICIPATION REQUIREMENTS AND MECHANICS OF THE PROMOTION

The requirements for participation are as follows:

• Participation will be open to those persons who are over 18 years of age.
• Only Users who have an Instagram account will be able to participate.
• Participants must follow the Instagram profile, comment on the brand’s publication on the social network Instagram tagging 1 friend and liking the post, during the participation period.
• Participants may only participate with a single Instagram profile. If a Participant is found to be participating with multiple Instagram profiles, he/she will be disqualified.
• The application will accumulate mentions of the same Participant even if they are in different comments.

4.- CONDITIONS OF THE PROMOTION AND PRIZES

A winner will be chosen randomly by means of a specialised platform. The winner will be notified on 25 October through the brand’s social profiles, together with the certificate of validity of the draw.

The prize will consist of a ticket for 2 people to attend the New Year’s Eve Gala to be held on 31 December, starting at 21:30h, at the Tablao El Palacio Andaluz in Seville (Spain) and accommodation for that night in a 4* hotel in Seville (Spain). The prize cannot be exchanged for cash or any other prize. The winner will be able to enjoy his or her gift on 31 December 2024.

The winner will be able to contact the Company within 15 days from the date on which it is announced on the brand’s social media profile. If no such contact is made within the stipulated period, the draw will be declared void or another winner will be assigned, according to preference.

The holding of the draw, as well as the awarding of the prize are subject to the tax regulations in force.

5.- DISQUALIFICATIONS AND PENALTIES

The following will not be allowed to participate:

• Companies.
• Fraudulent profiles or those who seek to promote themselves through the draw.
• The staff of El Palacio Andaluz.

If it becomes evident that any of the Participants do not comply with the requirements demanded in the Rules, or the data provided to participate are not valid, their participation will be considered null and void and they will be automatically excluded from the Promotion, losing all rights to the prizes awarded by virtue of this Promotion.

The Company reserves the right to declare the draw void.

6.- PUBLICATION OF COMMENTS OR OPINIONS

Comments or opinions whose content is considered inappropriate, offensive, insulting or discriminatory or which could infringe the rights of third parties will not be allowed. Comments against an individual that violate the principles of the right to honour, personal and family privacy and the right to one’s own image will not be allowed. We shall not be held responsible for any damage caused by comments made by Participants in the Promotion, which may at any time offend the sensibilities of other Participants.

The participation in this Promotion, as well as the publication of the comments made by the Participants in the publications, may not violate the Instagram Community Rules under any circumstances.

If fraudulent means of participation, such as the use of bots in the comments, are discovered by the Company, the prize will not be awarded and will remain the property of the Company.

7.-EXEMPTION FROM LIABILITY

By way of example, but not limitation, we shall not be held responsible for possible losses, theft, delays or any other circumstance attributable to third parties that may affect the development of this Promotion, nor shall we be held responsible for the use made by the Participant with regard to the prize obtained from this Promotion.

We do not assume responsibility in cases of force majeure or unforeseen circumstances that may prevent the Promotion from taking place or the total or partial enjoyment of the prize.

In the event that this Promotion cannot be carried out, either due to fraud detected in the same, technical errors, or any other reason that is not under the control of the Company and that affects the normal development of the Competition, we reserve the right to cancel, modify or suspend the same, including the participation website.

The promotion is not sponsored, endorsed, administered by, or associated in any way with Facebook/Instagram and Participants release these social networks from any liability for any damages arising from the promotion.

8.- PROTECTION OF PERSONAL DATA

The company responsible for the treatment of your data is El Palacio del Embrujo S.L., with address at Calle Matemáticos Rey Pastor y Castro, 4, 41092, Seville, and identification number B41705971.

In accordance with the provisions of the General Data Protection Regulation, by accepting these Legal Bases, each participant consents to their personal data being included in a file, owned by the company, for the purpose of managing the prize draw, as well as disseminating and publicising its results, and processing the delivery of the prize.

We inform you that you can exercise your rights of access, rectification, deletion, opposition, limitation of processing, portability, forgetfulness and not to be subject to automated individual decisions by sending an e-mail to comercial@elpalacioandaluz.com or by letter addressed to the Customer Service Department of EL PALACIO DEL EMBRUJO S.L., at the following address: Calle Matemáticos Rey Pastor y Castro, 4, 41092, Seville, attaching in both cases a copy of an identification document.

Without prejudice to any other administrative or judicial remedy, the Participant shall have the right to lodge a complaint with a Supervisory Authority, in particular in the Member State in which he/she has his/her habitual residence, place of work or place of the alleged infringement, in case he/she considers that the processing of his/her personal data is not lawful, as well as in the event that the exercise of his/her rights is not satisfied.

For this reason, the Participant declares that he/she has been informed of the conditions on personal data protection and accepts and consents to the processing of his/her personal data.

9.- CHANGES AND ACCEPTANCE

We reserve the right to modify or extend these promotional terms and conditions, insofar as this does not prejudice or undermine the rights of the Participants in the Promotion.

The mere fact of participating in the draw implies that the Participant fully accepts the conditions of these Terms and Conditions. Likewise, participation in a prize draw of this nature implies acceptance of the rules of the social network Instagram and Facebook through which it is carried out.

10.- APPLICABLE LAW AND JURISDICTION

These terms and conditions shall be governed in accordance with Spanish law. The Courts and Tribunals of the city of residence of the Participant will be competent to resolve any claim or dispute that may arise in relation to the validity, interpretation or fulfilment of these rules.
