1. COMPANY ORGANIZING THE PROMOTION
The company El Palacio del Embrujo S.L., with registered office at Calle Matemáticos Rey Pastor y Castro, 4, 41092, Seville, and identified by registration number B41705971, is organizing a sweepstakes (hereinafter, “the Promotion”), to be conducted online, exclusively for users in accordance with the provisions of the “Participation Requirements” section.
The purpose of this giveaway is to reward our followers for their loyalty.
2. START DATE AND END DATE
The promotion will take place in Spain, beginning on November 4, 2026, at 12:00 (GMT +1:00 Madrid) and will end on November 8, 2026, at 23:59 (GMT +1:00 Madrid).
The Company reserves the right not to proceed with the promotional campaign if, by the stated start date, fewer than 100 participants have registered. Similarly, the Company may extend the promotional campaign by one additional week, with the new end date being November 15, 2026, at 23:59 (CET +1), in the event that fewer than 100 participants have registered.
3. ELIGIBILITY REQUIREMENTS AND PROMOTION RULES
The requirements for participation are as follows:
- Anyone who is 18 years of age or older may participate.
- Only users who have an Instagram account may participate.
- Participants must follow the Instagram account, comment on the brand's post on Instagram by tagging one friend, and like the post during the contest period.
- Participants may enter only once using a single Instagram profile. If a participant is found to be entering with multiple Instagram profiles, they will be disqualified.
- You may enter as many times as you like, as long as you leave a comment mentioning a different Instagram user in each one.
4. PROMOTION TERMS AND CONDITIONS AND PRIZES
A winner will be selected at random using a specialized platform. The winner will be announced on November 11 via the brand’s social media accounts, along with the certificate of validity for the drawing. If the entry period is extended, this announcement will be made on November 18.
The prize consists of two tickets to attend the New Year’s Eve Gala, which will be held on December 31, starting at 9:30 p.m., at the Tablao El Palacio Andaluz in Seville (Spain), along with overnight accommodations at a 4-star hotel in Seville (Spain). The prize cannot be exchanged for cash or any other prize. The winner may enjoy their prize on December 31, 2026. The prize does not include travel or transportation, nor does it include anything else not specifically detailed in these terms and conditions.
The winner may contact the Company within 15 days of the date the winner is announced on the brand’s social media profile. If no contact is made within the stipulated period, the drawing will be declared void or another winner will be selected, as preferred.
The drawing, as well as the awarding of the prize, are subject to current tax regulations.
5. DISQUALIFICATIONS AND PENALTIES
The following individuals are not eligible to participate:
- Companies.
- Profiles that are fraudulent or that seek to promote themselves through the giveaway.
- The staff comprising El Palacio Andaluz.
If it is determined that any Participant does not meet the requirements set forth in the Rules, or if the information provided to participate is invalid, their participation will be deemed void, and they will be automatically excluded from the Promotion, forfeiting all rights to the prizes awarded under this Promotion.
The Company reserves the right to declare the drawing void.
6. POSTING COMMENTS OR OPINIONS
Comments or opinions whose content is deemed inappropriate, or that are offensive, defamatory, or discriminatory, or that could infringe on the rights of third parties, will not be permitted. Likewise, comments directed against an individual that violate the principles of the right to honor, personal and family privacy, and personal image will not be permitted. We will not be liable for any damages caused by comments made by Promotion Participants that may, at any time, offend the sensibilities of other Participants.
Participation in this Promotion, as well as the posting of comments by Participants on the posts, must not, under any circumstances, violate Instagram's Community Guidelines.
If the Company discovers that fraudulent means were used to participate—such as the use of bots in the comments—the prize will not be awarded to you and will remain the property of the Company.
7. DISCLAIMER OF LIABILITY
By way of example, but not limited to, we are not liable for any loss, theft, delay, or any other circumstance attributable to third parties that may affect the conduct of this Promotion, nor are we liable for the Participant’s use of the prize won through this Promotion.
We assume no liability in cases of force majeure or unforeseeable circumstances that may prevent the Promotion from taking place or the full or partial enjoyment of the prize.
In the event that this Promotion cannot be carried out—whether due to detected fraud, technical errors, or any other reason beyond the Company’s control that affects the normal conduct of the Contest—we reserve the right to cancel, modify, or suspend the Promotion, including the participation website.
This promotion is not sponsored, endorsed, administered by, or otherwise associated with Facebook or Instagram; therefore, participants release these social media platforms from any liability for any damages that may arise from the promotion.
8. PROTECTION OF PERSONAL DATA
The entity responsible for processing your data is El Palacio del Embrujo S.L., located at Calle Matemáticos Rey Pastor y Castro, 4, 41092, Seville, with identification number B41705971.
In accordance with the provisions of the General Data Protection Regulation, by accepting these Terms and Conditions, each participant consents to having their personal data included in a database owned by the organizer for the purpose of administering the drawing, as well as disseminating and publicizing its results, and processing the awarding of the prize.
We would like to inform you that you may exercise your rights of access, rectification, erasure, objection, Restriction of Processing, Data Portability, the Right to be Forgotten, and the right not to be subject to automated individual decision-making by sending an email to comercial@elpalacioandaluz.com or by mailing a letter to the Customer Service Department of EL PALACIO DEL EMBRUJO S.L. at the following address: Calle Matemáticos Rey Pastor y Castro, 4, 41092, Seville, attaching a copy of a valid identification document in both cases.
Without prejudice to any other administrative remedy or legal action, the Participant shall have the right to file a complaint with a supervisory authority, in particular in the Member State where the Participant has his or her habitual residence, place of work, or the location of the alleged infringement, if the Participant believes that the processing of their personal data does not comply with the regulations, or if they are not satisfied with the manner in which their rights have been exercised.
For this reason, the Participant hereby declares that he or she has been informed of the terms and conditions regarding the protection of personal data and accepts and consents to the processing of such data.
9. CHANGES AND ACCEPTANCE
We reserve the right to modify or expand these promotional terms and conditions, provided that such changes do not harm or undermine the rights of the Promotion participants.
The mere act of participating in the drawing implies that the Participant fully accepts the terms and conditions of these Legal Terms. Furthermore, participation in a drawing of this nature implies acceptance of the rules of the Instagram and Facebook social media platforms through which the drawing is conducted.
10. APPLICABLE LAW AND JURISDICTION
These Terms and Conditions shall be governed by Spanish law. The courts and tribunals of the Participant’s city of residence shall have jurisdiction to resolve any claim or dispute that may arise in connection with the validity, interpretation, or enforcement of these Terms and Conditions.
